Please read these Terms of Use ("Terms") carefully before using Whisper at whisper.day ("Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using Whisper, you confirm that you:

Are at least 16 years old (or the minimum age required by your country's data protection law)
Have read and agree to these Terms and our Privacy Policy
Have the legal capacity to enter into this agreement

2. Description of Service

Whisper is an AI-powered entertainment tool that generates personalised daily messages using statistical calculations derived from your birth date and today's date. Messages are generated by the Claude AI model operated by Anthropic. Whisper is designed for personal reflection and entertainment purposes.

2.1 Nature of the Service

The Whisper provides AI-generated reflections, narratives, and Aura Portraits derived from divination frameworks including astrology, BaZi, numerology, and others. All output is interpretive and intended for personal reflection, entertainment, and creative expression. Nothing generated by The Whisper constitutes a factual claim, prediction, statement of fact, or professional advice (legal, medical, psychological, or financial) about any person — including yourself, third parties, or public figures.

3. Entertainment Purpose Only

Whisper is provided for entertainment and personal reflection purposes only.

Messages generated by Whisper are produced by statistical calculation and artificial intelligence
Messages are not professional advice of any kind — including medical, financial, legal, or psychological advice
Messages do not predict the future and must not be relied upon for important life decisions
We make no warranty that messages are accurate, complete, or suitable for any particular purpose
Results vary between users and no specific outcomes are guaranteed

You use the Service and any messages generated at your own discretion and risk.

4. Account Registration

To use Whisper you must sign in with a Google account. You agree to:

Provide accurate information during onboarding
Keep your account information up to date
Not share your account with others
Notify us immediately at hello@whisper.day if you suspect unauthorised access to your account

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to reverse-engineer, scrape, or systematically extract data from the Service
Attempt to circumvent authentication or security measures
Use automated tools to access the Service at a rate that would impose an unreasonable load
Impersonate another person or misrepresent your identity

5.1 Orbits — Counterpart Data and Consent

Whisper's Orbits feature lets you receive a daily reflection about a relationship between you and another person ("counterpart"). When you create an orbit you may enter minimal information about the counterpart (a first name or nickname, a birth date, optionally a birth hour and city/country).

By creating an orbit you confirm that:

You believe the counterpart would be comfortable with you using this minimal information for a private daily reflection generated by AI;
You will not enter sensitive data such as the counterpart's surname, contact details, address, or any information they would consider private beyond what is described in our Privacy Policy;
You will not use Orbits to harass, surveil, profile, or otherwise target another person.

A counterpart who learns that their data has been entered into Whisper may at any time request its deletion by contacting privacy@whisper.day, in which case the orbit will be removed within 30 days. For how counterpart data is handled, see Privacy Policy §2.5.

When you create an Orbit using another person's birth date, you represent that one of the following applies: (a) you have that person's consent, (b) the birth information is publicly known, or (c) you have a legitimate personal context for using it. Ghost Orbit sharing is restricted to protect the privacy of counterparts who have not yet joined The Whisper — in particular, the Personal share style is disabled for Ghost Orbits to prevent distribution of images containing another person's name without their consent.

5.2 Third-Party Birth Information

Birth dates are not classified as sensitive personal information in most jurisdictions, particularly when concerning public figures whose birth information is widely known. The Whisper does not verify whose birth information a user enters. If you enter the birth date of another person — a friend, partner, family member, public figure, historical figure, or fictional character — you are solely responsible for any consent required and for the consequences of generating, saving, or sharing readings based on that input.

5.3 Public Figures and Creative Expression

Readings, Aura Portraits, and Orbits generated from the publicly known birth information of public figures, historical figures, or fictional characters are permitted as creative and reflective expression. Such outputs are interpretive narratives produced by applying divination frameworks to publicly available data — they do not represent factual claims about, statements by, or private characteristics of the named individual. The Whisper makes no representation that any reading reflects the actual personality, beliefs, behavior, or circumstances of any real person.

6. User-Generated Content and Sharing

When you save, download, or share a reading, Aura Portrait, or Orbit output, you become responsible for the content you publish. You agree not to use shared output to harass, defame, threaten, or impersonate any person, or to suggest endorsement by any individual named in the reading. The Whisper does not monitor, endorse, or take editorial responsibility for content shared outside the app.

7. Intellectual Property

All content, software, and technology comprising Whisper — including but not limited to the interface design, underlying code, and the "Whisper" brand — is owned by us or our licensors and protected by applicable intellectual property laws.

Message content generated for your account is provided to you for personal, non-commercial use only.

8. Paid Features

The Service includes free and paid subscription tiers. Paid features are clearly labelled and subject to the pricing terms presented at the time of purchase. Payments are processed securely by our payment provider. You will never be charged without explicit consent.

9. Service Availability

We strive to keep Whisper available at all times but do not guarantee uninterrupted access. We may suspend, modify, or discontinue the Service at any time, with or without notice.

10. Email Communications

If you enable Daily Whisper email in your account settings, you agree that we may send one Daily Whisper email per day (typically around your local morning time based on your timezone settings).

You can turn Daily Whisper email on or off at any time in Settings.
You can also unsubscribe using the link included in each email.
Disabling or unsubscribing may take effect immediately or shortly after processing.
Transactional account or legal notices may still be sent where required to operate the Service or comply with law.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA OR GOODWILL.

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid to us in the twelve months preceding the claim (or, if you have not paid us anything, USD $0).

Nothing in these Terms limits liability that cannot be excluded by law (e.g. liability for fraud or death/personal injury caused by negligence).

13. Termination

You may request deletion of your account and personal data at any time by contacting privacy@whisper.day (see our Privacy Policy for how we handle erasure). General enquiries about these Terms may still be sent to hello@whisper.day. We may suspend or terminate your account if you violate these Terms.

Upon termination, your right to use the Service ceases. We will delete your personal data in accordance with our Privacy Policy.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of Japan, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Tokyo, Japan, unless applicable consumer protection law in your jurisdiction requires otherwise.
