Please read these Terms of Use ("Terms") carefully before using En at whisper.day ("Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using En, you confirm that you:

  • Are at least 16 years old (or the minimum age required by your country's data protection law)
  • Have read and agree to these Terms and our Privacy Policy
  • Have the legal capacity to enter into this agreement

2. Description of Service

En is an entertainment service that generates personalised daily oracle readings and individual divination readings (zodiac, blood type, Four Pillars, numerology, tarot) using artificial intelligence. Readings are generated by the Claude AI model operated by Anthropic.

3. Entertainment Purpose Only

En is provided for entertainment purposes only.

  • Oracle and divination readings are not professional advice of any kind (medical, financial, legal, psychological, or otherwise)
  • Readings do not predict the future and should not be relied upon for important life decisions
  • We make no warranty that readings are accurate, complete, or suitable for any particular purpose

You use the Service and any readings at your own discretion and risk.

4. Account Registration

To use En you must sign in with a Google account. You agree to:

  • Provide accurate information during onboarding
  • Keep your account information up to date
  • Not share your account with others
  • Notify us immediately at hello@whisper.day if you suspect unauthorised access to your account

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse-engineer, scrape, or systematically extract data from the Service
  • Attempt to circumvent authentication or security measures
  • Use automated tools to access the Service at a rate that would impose an unreasonable load
  • Impersonate another person or misrepresent your identity

6. Intellectual Property

All content, software, and technology comprising En — including but not limited to the interface design, underlying code, and the "En" brand — is owned by us or our licensors and protected by applicable intellectual property laws.

Reading content generated for your account is provided to you for personal, non-commercial use only.

7. Paid Features (Future)

The Service is currently free. We may introduce optional paid features in the future. Any paid features will be clearly labelled and subject to additional terms presented at the time of purchase. You will never be charged without explicit consent.

8. Service Availability

We strive to keep En available at all times but do not guarantee uninterrupted access. We may suspend, modify, or discontinue the Service at any time, with or without notice.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA OR GOODWILL.

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid to us in the twelve months preceding the claim (or, if you have not paid us anything, USD $0).

Nothing in these Terms limits liability that cannot be excluded by law (e.g. liability for fraud or death/personal injury caused by negligence).

11. Termination

You may delete your account at any time by contacting hello@whisper.day. We may suspend or terminate your account if you violate these Terms.

Upon termination, your right to use the Service ceases. We will delete your personal data in accordance with our Privacy Policy.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Japan, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Tokyo, Japan, unless applicable consumer protection law in your jurisdiction requires otherwise.
